Recently, the Prime Minister announced the launch of a new scheme aimed at tackling illegal working in the UK. The introduction of a new digital ID system will mean it becomes compulsory to hold a digital ID to be eligible for work in the UK. As a result, this will become a recognised form of ID when conducting right to work checks.
Timeline for Implementation
This new scheme will take time to implement, and we must await further guidance. However, what we do know regarding the timeline is that Prime Minister Keir Starmer has stated it will be rolled out before the end of this Parliament. In other words, prior to the next general election, which must legally take place no later than August 2029.
Background: Increase in Penalties for Illegal Working
You may recall that in January 2024, the Government at the time increased financial penalties for businesses found to be employing illegal workers. This was enacted through the Immigration (Employment of Adults Subject to Immigration Control) (Maximum Penalty) (Amendment) Order 2024.
This led to a significant rise in fines:

For a first breach, the fine increased from £15,000 to £45,000 per illegal worker.

For second and subsequent breaches, the penalty rose from £20,000 to £60,000 per illegal worker.
Latest Government Data on Illegal Working
In today’s announcement, the Government reported a 50% rise in illegal working arrests since taking office. Specifically, 49,341 people were found to have entered the UK without permission in the year to June 2025 — a 27% increase compared to the previous year.
Additional Benefits of Digital ID
While the main objective is to combat illegal working, the introduction of the digital ID system will also make it easier for individuals to access Government services.
Right to Work Checks: A Timely Reminder
This announcement serves as a timely reminder of the importance of conducting right to work checks before an individual begins employment. In some cases, where the right to work is only granted for a limited time, employers must ensure they have processes in place to carry out follow-up checks before that right expires.
